e-Bidding System

TERMS & CONDITIONS:-

1. The financial bidding will be through E-bidding System. Tender form and BOQ can be filled and downloaded by original contractor available of the official website of LG&RDD, (www.lgkp.gov.pk) Khyber Pakhtunkhwa after publishing of NIT.
2. The bidder are required to fill Electronic Bids online and attach Scan copy Bid Security in shape of original Call Deposit in the name of Procuring Entity and submit hard copy of the same printed electronic bid form to the office of Assistant Director LG & RDD D.I.Khan.
3. Sealed bids send through registered mail/ couriers services should reached up to the specific time and date as mentioned above.
4. All those contractors/firms are eligible to participate the tender who are registered with inspectorate of Electricity, Energy & Power Deptt; Khyber Pakhtunkhwa of Electricity act 1937 under Rule 48 & hold Class        E License as well as provide one-year warranty of the particulars as per PESCO SOP.
5. The contractor is having representative may be present at the time of opening of Electronic bids opening.
6. The call Deposits I.e. Bid Security for the work/contract must be prepared after publishing of NIT, before closing time of the Electronic bid apply.
7. The contractors quoting their bids up to a limit of 10% below Engineer estimate shell submit bid security @ of 2% only of Engineer Estimate.
8. The contractor quoting their bids more than 10% below up to 20% below on Engineer’s Estimate shell submit along with their bids 8% Additional security of Engineer estimate in addition to 2 % bid security. If the bid is not accompanied with the required amount of additional security, then the bid shell be considered as non-responsive and 2% bid security shell be forfeited in the fever of Government and the second lowest bidder and so on will be considered accordingly.
9. In case a contractor quoting bid more then 20% below shell submit with his bid in additional security on Engineers Estimated cost equal to the differential amount of submitted bid and Engineer Estimate along with detailed rate analysis. In case of more then 20% below bids, if the bid is not accompanied by the detailed rate analysis and/or required amount of additional security, then the bid shell be considered as Non-responsive. All the securities submitted along with such non-responsive bid shell be fortified in favor of Government and the second lowest bidder and so on will be considered accordingly as per KPPRA Notification NO. 6058-71 Peshawar, the May 10,2022.
10. In case detailed rate analysis submitted with the bid as, in view of procuring entity, not convincing, the Head of the procuring entity may have declared such bid as non-responsive without any forfeiture of bid security and record reason thereof.
11. The procuring entity may offer the contract to the next lowest bidder after due diligence in the context of financial difference between such two bids are may advertised procuring opportunity afresh. KPPRA Notification. 6058-71 Peshawar, the May 10,2022.
12. Any Electronic bidder who provide falls, or, materially inaccurate or incomplete or do not send information in hard form will be disqualified as per KPPRA Act Section 29 (1) read with KAPRA Rule (43) Further more for procuring entity/ executing Agency will recommend and sent cases for Debarring/ Blacklisting and will take action in light of approved procedure/ mechanism as per KPPRA Act Section 29(2) read with KPPRA Rule (44).
13. Electronic bids will be remain valid for 90 days from the closing date of bids. (As decided by the procuring entity/executing agency in light of standard bidding documents).
14. The firms/contractors who wants to participate in tendering process may approach Directorate General LG&RDD Peshawar within two days before closing time of Electronic apply for uploading their name on the official website i.e (http://www.lgkp.gov.pk/).
15. All bidders are required to be registered with Khyber Pakhtunkhwa Revenue Authority, established under the Khyber Pakhtunkhwa Finance Act, 2013( Khyber Pakhtunkhwa Act NO XXI of 2013), for works consulting and non-consulting service as listed and Schedule-II of the Act a bid.
16. In case the bid become a tie the contractor shell be decided though a free toss in presence of bidder which shell be final.
17. The PEC in KPPRA registration (Active Tax Payer) must be valid for current Financial Year.
18. The time limit of each work shell be as per work order the issued to successful bidder and the contractor will have to start work within 15 days’ time period after the issuance of work order failing which the work be cancelled and security/ additional security (if any) will be forfeit.
19. All applicable taxes will be recoverable as per directive of the government vogue.
20. The procuring entity may reject any or all bids after communicating the reason for rejection at any time prior to the award of contract.
21. Any condition made in terms and conditions in the NIT advertised in the newspaper will be implanted as per KPPRA Rules.  
22. The Work order will be issued subject to release of fund.  
23. All material testing and sorts of tests will be performed by contractor on the demand of procuring entity.
24. Bidders may obtain bidding documents and further information from the office of Assistant Director (Senior) LG&RDD Tehsil (HQ) D.I.Khan on any working day before closing date.
25. The same terms and conditions should be considered for the advertisement.
26. The successful bidder/contractor shell be responsible to produce satisfactory certificate of the work done from the concerned MPA and technical committee constituted for the purpose before the submission of bill for the payment.
