e-Bidding System

Terms & Conditions:

1. Tender Form can be downloaded after publication in the National Dallies & KPPRA’s Website by the original registered contractors from Local Council Board website (www.lgkp.gov.pk).
2. All the enlisted contractors who renewed license for the current financial year (2022-23) from Local Council Board shall offer their bids by filling rates online. All bidders are required to be registered with the Khyber Pakhtunkhwa Revenue Authority, established under the Khyber Pakhtunkhwa Finance Act, 2013 (Khyber Pakhtunkhwa Act No. XXI 20130 for works, consulting and non-consulting services as listed in Schedule-II of the Act ibid”.
3. The TMA Chitral shall award print work order through New E-Tendering System. Any work order awarded and work issued by the TMA without E-Tendering System shall henceforth no validity.
4. The document must be attached with the bids such as

1. 2%Earnest Money/additional security in shape of original Call Deposit in the name of Tehsil Municipal Officer TMA Chitral from scheduled Banks,
2. Enlistment Copy of Local Council Board /KPPRA for the year (2022-23) updated.
3. Registration Copy of Pakistan Engineering Council with relevant codes and updated.
4. Copy of CNIC for each scheme in a separate envelop highlighting name of work & Serial number written over the envelop.

5. Sealed bids must be sent through registered mail/Postal Service (No tender form will be entertained by hand) should be reached on 15-02-2023 up to 12:00 AM and will be opened on the same date at 2:00PM in the presence of bidders by the tender committee. Delay in delivering of the tender documents will be the responsibility of the bidders.
6. As per Notification No. S.R.O. (14)/Vol: 1-24/2021-22 dated May 10, 2022 by the Government of Khyber Pakhtunkhwa Public Procurement Regulatory Authority, The Contractors quoting their bids up to a limit of 10% below Engineer Estimate shall submit bid security to the extent of 2% only of Engineer Estimate.
7. The Contractors quoting their bids more than 10% below up to 20% below on Engineer’s Estimate shall submit along with their bids 8% Additional Security of Engineers’ Estimate Cost in addition to 2% bid security.  If the bid is not accompanied with the required amount of additional security then it will be considered as non-responsive and the 2% security shall be forfeited in favour of Government and the second lowest bidder and so on will be considered accordingly.
8. Similarly, a contractor quotes more than 20% below shall submit with his bid an additional security on Engineer’s Estimated cost equal to the differential amount of submitted bid and Engineer’s Estimate along with detailed rate analysis. In case of more that 20% below bids, if the bid is not accompanied by the detailed rate analysis and / or required amount of additional security, then the said bid shall be considered as non-responsive. All the securities submitted along with such non-responsive shall be forfeited in favour of Government and 2^nd lowest bidder and so on will be considered accordingly.
9. In case detailed rate analysis submitted with the bids is, in view of the Procuring Entity, not convincing, the Head of the Procuring Entity may declare such bid as non-responsive without any forfeiture of bid securities and record reasons thereof.
10. The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertise procurement opportunity afresh.  
11. The Engineer estimates are framed on the MRS-2022 B-1.
12. The Tender Forms and BoQs must be signed by the original contractor.
13. The successful contractors have to pay stamp duty along-with contingency charges and all applicable Provincial/Federal Government Taxes issued from time to time.
14. Bid Security of some or all the bidders will be retrained by the employer till approval of tender/bid validity period.
15. Complete bids (original must reach to the office of TMA Chitral on or before the fixed date/ time.
16. Incomplete conditional or telegraphic tenders shall not be accepted.
17. The Department will not be bound to provide any machinery/testing laboratory and the total cost on it will be borne by the contractors themselves.
18. Any bidder who provides incorrect information shall be disqualified.
19. In case of bids become tie, the award of the contractor shall be decided through an electronic toss which shall be binding and final.
20. The time limit of each work shall be as work order issued to successful bidders and the contractor will have to start the work within 15 Days’ time period after the issuance of Work Order failing which the work will be cancelled and security/additional security (if any) will be forfeited.
21. Work order will be issued subject to availability of funds.
22. The procuring entity may reject any or all bids after communicating the reasons for rejection at any time prior to the award of the contractor.
23. Any addition made in terms & conditions in the NIT advertised in the newspaper will be implemented as per KPPRA Rules.
