NOTICE INVITING E-BIDDING

              TERMS AND CONDITIONS

  1. (1). The financial bidding will be online through E-Biding System. Tender forms and BOQ can be filled online and downloaded from the official website of Local Government, Elections and Rural Development Department (www.lgkp.gov.pk) after one day of publishing NIT.

     (2). The bidders are required to fill Electronic bids online and attach scan copy of Bid Security in shape of original Call Deposit in the name of Administrator VCs/NCs District Mansehra in respect of scheme above along with (Additional Security if any), and submit hard copy of the same printed electronic bid form to the undersigned.

     (3). Electronic bids and original call deposit's received through fax or by hand will not be acceptable. Sealed bids sent through registered mail/courier service should be reach up to the specified time and date as mentioned above in office of the undersigned

    (4). The eligible bidder(s) must have the relevant codes for the above mentioned works as per Pakistan Engineering Council.

     (5). The contractor(s) or his/their representative(s) may be present at time of opening of electronic bids opening.

     (6). The call deposit i.e. Bid Security along with (Additional Security if any), for the work/contracted muse be prepared after publishing of NIT, before closing time of the electronic bid apply.

     (7). (i). The contractors quoting their bids up to a limit of 15% below Engineer estimate shall submit bid security to the extent of 2% of Engineer Estimate only (ii). The contractors quoting their bids more than 15% below on Engineer estimate shall submit along with their bids an Additional Security to the extent of their bids/rates more than 15% below on engineer estimate in the form of percentage. (iii). In case the bidder quoted more than 15% below the Engineer Estimate and the bid is not accompanied by the Additional Security then the bid shall be considered as non-responsive and the 2nd lowest bidder and so on will be considered accordingly. (iv). In case a contractor quotes more than 30% below on Engineer Estimate, the procuring entity shall, in addition to additional security, require the contractor to produce detailed rate analysis of his bid price in relation to any or all the items of bill of quantities scope of work, allocation of risks and responsibilities and/or any other requirements of the bid solicitation document. The contract shall be awarded to the lowest evaluated bidder who has satisfies and procuring entity on rate analysis. However, if the procuring entity determines that the contractor has failed to demonstrate its capability to execute the contract at the offered price, the matter shall be referred to the next higher authority for rejection of the bid on the basis of being financially unviable. (v). After commencements of work by the successful bidder, the procuring entity may replace the Additional Security with a bank guarantee of the same amount from the scheduled bank, if the already deposited security is not in the form of bank guarantee. (vi). The Additional Security shall be released to the contractor in four installments that is 25% to be released up completion of 25% of the project, 50% to be released upon completion of 50% of the project. 75% to be released upon completion of 75% of the project and the remaining amount to be released after completion of the project.

      (8). Any Electronic Bidders who provide false, fake, or materially inaccurate or incomplete or do not send information in hard form will be disqualified as per KPPRA Act Section 29(1) read with KPPRA Rule (43). Furthermore, the AD LG&RDD as a Procuring Entity/Executing Agency will recommend and send case for debarring/Blacklisting such contractor(s) & bidders and will initiate / take action in light of approved procedure / mechanism as per KPPRA Act Section 29(2) read with KPPRA Rule (44).

     (9). Electronic Bids will remain valid for 90 days from the closing date of bids. (in light of Standard Bidding Documents).

     (10). The PEC and KPRA registration (Active tax payer) must be valid for current financial year.

     (11). The Centralized Enlisted contractors with C&W department for the current financial year who wants to participate in tendering process may approach Directorate General LG&RDD Peshawar within two days before closing time of electronic apply for uploading their names on the official website i.e (www.lgkp.gov.pk).

     (12). All applicable taxes will be recoverable as per directives of the government in vogue.

     (13). Any addition made in the terms & conditions in the NIT advertised will be implemented as per KPPRA Rules. (14). The bidders will have to quote rate on Above/Below system, in case the bid becomes a tie, contract award shall be decided through toss which shall be the final, 10 any cutting/overwriting on the BOQ will be liable to rejection of the tender and will be declared defective and non-responsive.

     (15). Work order(s) shall be issued subject to issuance of AA by the competent authority, availability of funds and approval of schemes by the competent forum etc.

     (16). This Tender Notice shall also be uploaded on KPPRA website info@kppra.gov.pk.
