Sealed tenders based on MRS-2024 (1st Biannual)/NSI for the below mentioned Scheme are hereby invited on the basis of single stage single envelope procedure, from the government contractors pre- qualified vide PESCO letter No.4400-4446/COO/DDT/PESCO, dated 09-08-2022, registered with PESCO/ TESCO/WAPDA, PEC in the relevant category/codes and having registration, enlistment and renewal for the current financial year (2024-25) with C&W, enshrined in centralized enlistment policy, as per following schedule.
TERMS & CONDITIONS.

The Financial bidding will be through E-bidding System. Tender form and BOQ can be filled and downloaded by the contractor available on the official website of LG& RDD (www.lgkp.gov.pk) Khyber Pakhtunkhwa after Publishing of NIT.

The bidders are required to fill Electronic Bids online (up to specified time 12:00 AM midnight before the opening day) and upload Scanned copy of Bid Security in shape of original Call Deposit in the name of Procuring Entity i.e. Assistant Director, Local Govt. & Rural Dev. Department, Tribal District Mohmand and submit a hard copy of the same printed electronic bid along with original call deposits to AD Senior LG&RDD Tehsil HQ Upper Mohmand Office (Ghallanai).

Sealed bids sent through registered mail/Courier service should reach to the office of Assistant Director (Senior), Upper Mohmand at the target date and time and may send a duplicate copy of the same to Directorate General LG&RDD Office No.20 Sector B-5 Phase V Hayatabad Peshawar.

Only those contractors/firms will be eligible whose workshops are registered with PESCO/TESCO.

All those contractors/firms registered with Inspectorate of Electricity, Energy & Power Department Khyber Pakhtunkhwa vide electricity act 1937 Under Rule 48 & holder of license-E as well as providing One-year warranty of the particulars as per PESCO SOP are eligible to participate. Furthermore, the Bidders must have the relevant codes for the above mentioned works as per PEC (EE-04 & EE-05). The relevant codes shall be according to the items mentioned in BOQ while the contractor’s category shall be as per the estimated cost of the schemes. If the code and category does not match, the bid will be considered as non-responsive.
6- The contractor or his representative may be present at the time of opening of Electronic bids.
7-The call deposits i.e. Bid Security for the work must be prepared after publishing of NIT and before closing time of the Electronic bid apply.
8- The contractors quoting their bids on or below 10% Engineer estimate shall submit bid security @2% only of Engineer Estimate.
9- The contractor quoting their bids more than 10% to 20% below on Engineer’s Estimate shall submit along with their bids 8% Additional security of Engineer estimate in addition to 2% bid security. If the bid is not accompanied with the required amount of Additional security then the bid shall be considered as non-responsive and the 2% bid Security shall be forfeited in favor of Government. The second lowest bidder and so on will be considered accordingly.
10-In case, a contractor quoting bid more than 20% below, shall submit with his bid an additional security on Engineers Estimated cost equal to the differential amount of submitted bid and Engineer Estimate along with detailed rate analysis on the standard format prescribed procedure of analysis of MRS 2024 (Bi- annual). In case of more than 20% below bids, if the bid is not accompanied by the detailed rate analysis or the required amount of additional security, then the bid shall be considered as Non-responsive. All the securities submitted along with such non-responsive bid shall be forfeited in favor of Government and after due diligence the second lowest and next successive bidder will be considered accordingly as per KPPRA notification.
11- In case the detailed rate analysis submitted with the bid by the contractor aren’t found convincing then the Head of the procuring entity can declare such bid as non-responsive without any forfeiture of bid securities and record reason thereof.
12-As per KPPRA Rules, the procuring entity may offer the contract to the next lowest bidder after due Diligence in the context of financial differences between such two bids or may advertise procuring opportunity afresh
13-Any Electronic bidder who provide false or materially inaccurate or incomplete or do not send Information in hard form will be disqualified as per KPPRA Act Section29 (1) read with KPPRA Rule (43).Furthermore the Procuring Entity/Executing Agency i.e. this office will recommend and send cases for Debarring/Blacklisting and will take action in light of Approved Procedure/mechanism as per KPPRA Act section29 (2) read with KPPRA Rule (44) and the instructions issued by the DG LGRDD from time to Time.
14-Electronic bids will remain valid for 90 days from the closing date of bids.
15-The firms/contractors who want to participate in tendering process may approach Directorate General LG&RDD Peshawar within two days before the closing time of electronic apply for uploading their names on the official website i.e. (www.lgkp.gov.pk).
16-All Bidders are required to be registered with Khyber Pakhtunkhwa Revenue Authority, established under the Khyber Pakhtunkhwa Finance Act, 2013 (Khyber Pakhtunkhwa Act No.XXIof2013) ,for works, consulting and non- consulting Service as listed in Scheduled-II of the Act ibid.
17-In case the bid become tie the successful contractor shall be decided through toss which shall be final.
18-The PEC and KPRA registration (Active tax payer) must be valid for current Financial Year.
19-The time limit of each work shall be as per work order, issued to successful bidder and the contractor will have to start Work within 15 days after the issuance of work order failing which the work be cancelled and security /additional security (if any) will be forfeited.
20- All taxes applicable will be deducted as per directives of the government in vogue.
21-The procuring entity may reject any or all bids at any time prior to the acceptance of a bid in light of KPPRA Rule.47
22-Any addition made in terms & conditions in the NIT advertised in the newspaper will be implemented as per KPPRA Rules.
23-Work order will be issued subject to release of funds.
24-All sorts of tests i.e. material or others, will be performed by contractor as per the instructions of the Procuring entity, and provide to the procuring entity before processing of payment.
25- Interested bidders can download bidding documents from the official e-bidding website.
26- The successful contractor /firm will be responsible for production of complete pictorial evidence, both in hard and soft form (Pre-During-Post works) duly verified from the concerned technical committee.
27-The Successful bidder/contractor shall be responsible to obtain Quality Work done certificate from the concerned MPA and Technical Committee constituted for the purpose before the submission bill for the payment.
28- If needed, any amendment / corrigendum will be published in leading newspapers & on the website of KPPRA, therefore interested bidders must visit it regularly to avoid communication gap.
29- The time for submission of hard copies shall be 12:00 PM on or before the date of opening of tender.
30- In case of any emergency/ holiday, the tender shall be opened on the next working day.
