Terms & Conditions:
1. Tender form and BOQ can be downloaded by the original contractor available on the web site of LG&RDD(LCB)Khyber Pakhtunkhwa www.lgkp.gov.pk.
2. Registration of the contractor should be renewed from Local Government Elections & Rural Development Department (LCB) Khyber Pakhtunkhwa for the year 2020-2021, copies of CNIC, National Income Tax certificate and his registration must be attached with tender documents.
3. The original/ duplicate copy of sealed tender documents will be submitted to this office and tender documents must be reached upto the fixed dated and time mentioned above as per letter No CE/LCB/1-1/2016 dated 23-08-2016 was issued by the Chief Engineer LCB Khyber Phyber Pakhtunkhwa.
4. Any contractor/firm are bound to mention the rates as per notification No KPPRA/M&E/Estt:/1-5/2016”Above/Below System”.
5. As per Notification No.KPPRA/M&E/Estt:/1-17/2019-20 dated 12.06.2020 in continuation of KPPRA Notification dated 24.05.2016, 06.06.2017 and dated 27.06.2018 the Provincial Government / Khyber Pakhtunkhwa Public Procurement Regulatory Authority (KPPRA) has been made following amendment for slandered bidding documents for procurement works.
i. The award of contractor shall be on the basis of above / below Engineer estimate on MRS instead of item rate basis.
ii. The percentage of bid security shall be 2% of the engineer estimate.
iii. In case of bid / rate quoted by the bidder more than 10% below engineer estimate, the additional bid security shall be sought from the successful bidder only to the exten: of additional bid security shall be equal to the impact of financial difference occurring in the quoted rates beyond 10% below engineer estimate.
iv. in such eventuality, the successful bidder shall be bound to produce the additional bid security within three (03) working days from the issuance of letter of acceptance failing which the procuring entity i.e executing agency shall forfeit the bid security of successful bidder and may also initiate legal proceeding against the bidder who repudiated the contract under KPPRA procurement rules.
v. The procuring entity / executing agency may offer the contract to next lowest bidder after due diligence in the context of financial different between such two bids and the market analysis in order to discourage cartel making and to protect public interest at large.
vi. Any such efforts to conspire to cartel making shall be considered as violation of Rules 44 and shall be attributed towards mis-procurement under Rules 54 of procurement Rules ibid.
6. In case bids become tie, the award of contract shall be decided through a free toss which shall be binding and final.
7. As per Provincial Government all the bidders /firms must to be registered with Khyber Pakhtunkhwa Revenue Authority established under the Khyber Pakhtunkhwa Finance Act,2013 (Khyber Pakhtunkhwa Act No.XXI of 2013).
8. All Federal and Provincial duties /stamp duty and taxes including sales tax will be recoverable as per directives of the Government issued from time to time.
9. The work order of all Developmental schemes to be issued on the availability of funds.
