e-Bidding System

General Terms and Conditions:

1. Tender documents/BOQs can be downloaded up-to one day prior to the last date of submission of Tender from Local Council Board Department web site at the address www.lcbkp.gov.pk.
2. The percentage of bid security shall be 2% of the engineer estimate, which will accompanied with the tender document in the shape of call-deposits in the name of Tehsil Municipal Officer, TMA Alpuri from scheduled Bank. Copies of the requisite documents like enlistment/renewal from Local Council Board LG&RDD Khyber Pakhtunkhwa, Income Tax certificate, CNIC and Registration of Pakistan Engineering Council as well as copy of registration from Khyber Pakhtunkhwa Revenue Authority must be attached with the tender documents.
3. The award of contract shall be based on above/below engineer estimate on MRS instead of item rate basis.
4. In case the contractors who quoted their rates more than 10% below engineer estimate, the additional bid security shall be sought from the successful bidder only to the extent of bid more than 10% below the engineer estimate in the form of percentage. The amount of additional bid security shall be equal to the impact of financial difference occurring in the quoted rates beyond 10% below engineer estimate.
5. In such eventuality, the successful bidder shall be bound to produce the additional bid security within three (03) working days from the issuance of Letter of Acceptance failing which the procuring entity shall forfeit the bid security of successful bidder and may also initiate legal proceeding against the bidder who repudiated the contract under KPPRA procurement rules.
6. The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids and the market analysis in order to discourage cartel making and to protect public interest at large.
7. Any such effort to conspire to cartel making shall be considered as violation of Rule 44 and shall be attributed towards mis-procurement under Rule 54 of Procurement Rules ibid.
8. The tender documents must be signed by an authorized person of the firm /Contractors.
9. Sealed Tender Documents through registered mail/Courier service shall must be reached up to the schedule date and time mentioned above which will be opened on the same date and time in the office of the TMA Alpuri in presence of contractors or their authorized representatives, the Tender Documents received after due date and time shall not be entertained in the proceedings. Timely submission / delivery of tender documents will be responsibility of the contractors concerned. The Documents received through fax or by hand will not be acceptable.
10. Sealed envelope of the tender documents in original  and duplicate Copy of tender Documents  will be submitted  to this  office  and this office will communicate duplicate Copy of tender Documents to Local Council Board Peshawar as per directions vide  letter no. CE/LCB/1-1/2016 dated 23/08/2016).
11. The Contractors who quoted their rates on website through E-biding system and fails to submit their documents and not withdraw his bid timely will be treated as per directives of Local Council Board KP vide Notification No. AOI/LCB/Estt:/19-6/17 dated 19/06/2017 and work will be awarded to the responsive Bidders/ contractors as per provisions of  KPPRA rules Vide Notification No. KPPRA/M&E/Estt:/1-5/2016 dated 24^th May 2016.
12. All federal and provincial duties/stamp duty/taxes including Seles tax will be deducted as per directives of the government issued from time to time.
13. If any documents submitted found false/bogus the contractors will be reported for legal proceedings. Incomplete/conditional bid shall not be acceptable.
14. Payments of work done to the contractor will be subject to the availability of funds under the relevant Head/Object.
15. Work order will be issued to the contractor subject to availability of fund/object. The completion period of the schemes subject to the work order.
16. If the rates between the contractors become equal, the successful Bidder will be decided through toss/draw.
