TETERMS & CONDITIONS.

1. Tender form and BOQ can be filled and downloaded by the original contractor available on the web site of LGE&RDD (LCB) Khyber Pakhtunkhwa after publishing. The same also can be seen on KPPRA official website (www.kppra.gov.pk).

1. 2% of Earnest Money must be accompanied with the tender documents in the shape of Call Deposit only, in the name of TMO, TMA Topi and call deposit will only be accepted from the Schedule Banks.
2. Matters pertaining to additional Security in case of abnormally low bids:

1. The contractor quoting their bids up to a limit of 10% below Engineer estimate shall submit bid security @ 2% only of Engineer Estimate.
2.  The contractor quoting their bids more than 10% below upto 20% below on Engineers’ Estimate shall submit along with their bids 8% Additional security of Engineer’s Estimated cost in addition to 2% bid security. If the bid is not accompanied with the required amount of additional security then it will be considered as non-responsive and the 2% bid security shall be forfeited in favour of Government and the second lowest bidder and soon will be considered accordingly.
3. [Similarly, a contractor quoting bid more than 20% below shall submit with his bid an additional security on Engineer’s Estimated cost equal to the differential amount of submitted bid and Engineers’ Estimate along with detailed rate analysis] . In case of more than 20%  below bids, if the bid is not accompanied by the detailed rate analysis and / or required amount of additional security, then the said bed shall be considered as non-responsive bib shall be forfeited in favour of Government and the 2^nd lowest bidder and so on will be considered accordingly.
4. In case detailed rate analysis submitted with the bids is, in view of the procuring Entity , not convincing , the Head of the procuring Entity may declare such bid as non-responsive without any forfeiture of bid securities and record reasons thereof.
5. The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertise procurement opportunity afresh.
6. After commencements of work by the successful bidder, the procuring entity my replace the Additional Security with a bank guarantee of the same amount from the scheduled bank ; if the already deposited security is not in the form of bank guarantee.
7. The Additional Security shall be released to the contractor in four installments i.e 1^st    installment of 25% to be released upon completion of 25% of the project , 2^nd installment of 25% to be released upon completion of 50% of the project,  3^nd installment of 25% to be released upon completion of 75% of the project and the  4^nd installment of 25% to be released after 100% completion of the project.
8. All previous orders, instructions and regulation issued regarding additional security shall stand superseded .

3. The security and additional security will be refunded as per rules.
4. Material testing expenses will be borne by the contractor concerned on the direction of Engineer in charge.

6. The contractor must be registered with Khyber Pakhtunkhwa Revenue authority and filed their monthly returns as per KPPRA Rules 37 (A) otherwise his bedding documents will not be entertained.
7. The original sealed printed tender documents along with duplicate will be submitted to this office in two separate envelopes along with Khyber Pakhtunkhwa Revenue Authority Registration certificate.
8.  The tender documents must be reached up to the fixed date and time mentioned above.
9. Time limits of each work shall be as per work order issued to successful bidders and contractor will have to start the work within 15 days time period after issuance of work order, failing which the work will be cancelled and security will be forfeited.
10. Only the first two figures after decimal of the rate will be considered for evaluation of the bid.
11. All Federal and Provincial duties/stamp duty & taxes including sales tax will be recoverable as per directives of the Government issued from time to time.
12. In case bids become tie, the award of contract shall be decided through a free toss which shall be binding and final.
13. If any of documents submitted with bidding documents found false/bogus, the contract of the contractor/firm shall stand cancelled and will be recommended for black listed.
14. The contractors/Firms once applied for a contract will only have an option to withdraw otherwise he will be bound to submit the tender form in the office concerned otherwise they will be recommended for black listing.
15.  Work order will be issued after release / availability of Fund.
