e-Bidding System

Terms & Conditions:

1. Tender form and BOQ can be downloaded by the original contractor available on the web site of LG&RDD(LCB)Khyber Pakhtunkhwa www.lgkp.gov.pk.
2. Registration of the contractor should be renewed from Local Government Elections & Rural Development Department (LCB) Khyber Pakhtunkhwa for the year 2020-2021, copies of CNIC, National Income Tax certificate and his registration must be attached with tender documents.
3. The original / duplicate copy of sealed tender documents will be submitted to this office and tender documents must be reached upto the fixed dated and time mentioned above as per letter No CE/LCB/1-1/2016 dated 23-08-2016 was issued by the Chief Engineer LCB Khyber Phyber Pakhtunkhwa.
4. Any contractor/firm are bound to mention the rates as per notification No KPPRA/M&E/Estt:/1-5/2016”Above/Below System”.

5. As per KPPRA Notification No S.R.O(14)/ Vol: 1-24/2020-21  dated 10-05-2022 pertaining of Additional Security in case of abnormally low bids: This regulation relates to the matters pertaining to Additional security @2% of the Engineering Estimate.

1. The contractor quoting their bids upto more than 10 % below on the Engineer’s estimate shall submit bid Security @ 2% only of Engineering Estimate .
2. The contractors quoting their bids more than 10% below upto 20% Below on Engineer’s Estimate shall submit along with their bids 8% Additional Security of Engineer’s estimate cost in addition to 2% bid security. If the bid is not accompanied with the required amount of additional security then it will be considered as non-responsive and 2% bid security shall be forfeited in favour of Government and the second lowest bidder and so on will be considered accordingly.
3. Similarly a contractor quoting bid more than 20% below shall submit with his bid an additional security on Engineer’s Estimate cost equal to the differential amount of submitted bid and Engineer’s Estimate along with detailed rate analysis. In case of more than 20% Below bids, if the bid is not accompanied by the detailed rate analysis and /or required amount of additional Security , then  said bid shall be considered as non-responsive. All the securities submitted along with such non-responsive bid shall be forfeited in favour of Government and the 2^nd lowest bidder and so on will be considered accordingly.
4. In case detailed rate analysis submitted with the bids in view of the procuring Entity, not convincing the Head of the procuring entity may declare such bid as non-responsive without any forfeiture of bid securities and record reasons thereof.
5. The Procuring Entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertise procuring opportunity afresh.
6. After commencements of work by the successful bidder, the procuring entity may replace the additional security with a bank Guarantee of the same amount from the scheduled bank: if the already deposited is not in the form of bank guarantee.
7. All previous orders, instructions and regulations issued regarding additional security shall stand superseded.

6. Any  contractor who has not relevant code in relevant field/general specialized code of PEC/LCB  has not has authorized relevant codes those contractors could not participate in the bidding process. Those contractors who has relevant code in relevant filed must be attached copy of enlistment where clearly mention codes. The original documents to be checked by the technical staff on the same day in the presence of contractors /authorized representative. If any contractor who has not relevant code and participated in the bidding process the competent authority has rights to sent the case to Provincial Government for debar/blacklisting.
7. In case bids become tie, the award of contract shall be decided through E-Toss, which shall be binding and final.
8. As per Provincial Government all the bidders /firms must to be registered with Khyber Pakhtunkhwa Revenue authority established under the Khyber Pakhtunkhwa Finance Act ,2013(Khyber Pakhtunkhwa Act No XXI of 2013).
9. All Federal and Provincial duties /stamp duty and taxes including sales tax will be recoverable as per directives of the Government issued from time to time.

10. The work order of all Developmental schemes to be issued on the availability of funds.
