(Notice Re-Inviting E. Bidding)

Sealed bids on the basis of “Single Stage Single Envelope System” under Rule 14 (2)(a) of KPPRA Rules 2014, are hereby invited from the contractors /firms enlisted with the Provincial Enlistment Committee Khyber Pakhtunkhwa / PDA for the current year and registered with Pakistan Engineering Council (PEC) for the year 2021-22 having sufficient experience in the field of works given below, on percentage above/below on the BOQ/Engineer cost estimate for the following works:-

TERMS& CONDITION

1.            The contractor / firm shall apply online via E- bidding on PDA web site, at www.pda.gkp.pk. The advertisement can also be seen on KPPRA website at www.kppra.gov.pk up to one day prior to schedule opening dates.

2.            2% (two percent) earnest money/bid security of the Engineer Cost Estimate must be accompanied in the shape of Call Deposit in name of the Director General, Peshawar Development Authority Peshawar, from scheduled banks in accordance with the Rule 20(2) of KPPRA Rules 2014 and subsequent amendments (if any).  Copies of the requisite documents like enlistment/renewal, Income Tax Certificate and PEC Registrations, Active NTN, Affidavit of never been black-listed by the Government / Semi-Government or any Autonomous body, etc must be attached with the bidding documents, while original be produced to the Tender Opening Committee for confirmation at the time of opening of the tender.

3.            The Bidders shall submit their Bids with requisite documents i.e. Active NTN / Income Tax Certificate and Enlistment with KPRA (Active) to the office of the undersigned through Registered Courier Service. The bids received by hand, not Registered Courier Service and late shall not be entertained.

4.            Affidavit to the affect that all Documents / Particular / Information furnished in connection is true and genuine and any false data/documents/ information provided by the contractor may result the firm in disqualification / blacklisting at any stage.

5.            The Contractors / Bidders who quote their Bids/ Rates upto a limit of 10% Below the Engineer’s Estimate shall submit Bid Security @ 2% of Engineer Estimate only as per KPPRA vide Notification No. S.R.O (14)/Vol: 1-24/2021-22 dated May 10, 2022/6058-71.

i)      The Contractors quoting their bids more than 10% below upto 20% below on Engineer Estimate shall submit along with their bids 8% additional security of Engineer Estimated bid cost in addition to 2% bid security. If the bid is not accompanied with the required amount additional security than it will be considered as non-responsive and the 2% bid security shall forfeited in favour of Government and the 2^nd lowest bidder and so on will be considered accordingly.

ii)     Similarly a contractor quoting bid more than 20% below shall submit with his bid an additional security on Engineer Estimated Cost equal to differential amount of submitted bid and Engineer Estimate along with detailed rate analysis. In case of more than 20% below bids, if the bid is not accompanied by the detailed rate analysis and / or required amount of additional security, then the said bid shall be considered as non-responsive all the securities submitted along with such non-responsive bid shall be forfeited in favour Government and the 2^nd lowest bidder and so on will be considered accordingly.

iii)   The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertisement procurement opportunity afresh.

6.            The bidding documents fee shall be added separately with bidding documents in favor of the Director General PDA. 

7.            Incomplete /disfiguring/overwriting/ delayed bids shall be considered non responsive. 

8.            All federal and provincial duties/stamp duty/taxes including kpra sales tax etc will be recoverable as per directives of the government issued from time to time.

9.            In case the bid becomes tie, it will be decided through open draw.

10.         The Firms/ contractor shall submit their bids by pressing / clicking “Finalize” option in the “Bid Details” section of E-bidding. After that the generated tender form shall be printed, signed and submitted along with BOQ and other documents mentioned in condition No 2 of this NIT.

11.         The procuring entity may reject any or all bids at any time prior to the acceptance of a bid. The procuring entity shall upon request communicate to any contractor who submitted a bid, the grounds for rejection of all bids, as per KPPRA Rule 47(1).

12.         Bid shall be filled online; Tender Form along with Call Deposit must reach (in hard form) on or before the fixed date / time.

13.          Validity of bid will be 90 days from the date of opening of bids.

14.         All the bidders must be registered and in the active Tax payer list of the Khyber Pakhtunkhwa Revenue Authority , established under the Khyber Pakhtunkhwa Finance Act,2013(KP Act No  XXI of 2013.

15.         Bid security of the bidder shall be retained by the procurement entity till approval of tender or bid validity period.

16.         Any corrigendum / addendum in aforementioned terms and conditions would be communicated to all the issuers.

17.         Other terms and conditions can be seen in the office of the undersigned on any working day during office hours.
