PESHAWAR DEVELOPMENT AUTHORITY

(NOTICE  INVITING - E -TENDER)

Sealed tenders on the basis of “Single Stage Two Envelope System” under Rules 14(2) (b) of KPPRA Rules 2014, are hereby invited from the contractors /firms enlisted with the Provincial Enlistment Committee Khyber Pakhtunkhwa / PDA for the current year and registered with Pakistan Engineering Council (PEC) for the year 2022-23 having sufficient experience in the field of works given below, on percentage above/below on the BOQ/Engineer cost estimate for the following works:-

TERMS& CONDITION

1. Tender document including Tender Form and Bill of Quantity (BOQ) can be downloaded upto one day prior to opening date from Peshawar Development Authority Website at the address www.pda.gkp.pk. The advertisement can also be seen on KPPRA website at www.kppra.gov.pk up to one day prior to schedule opening dates.

2. The eligible contractor/Firm are required to submit their Bids in separate sealed envelope i.e one envelopes containing “Technical Proposal” of the contractor/Firm, clearly marked as “Technical Bid”  accompanied with respective bidding documents fee, while the second envelope containing financial proposal/Bid price clearly marked as “Financial Proposal” Both Technical and Financial Proposals /Bids will be placed in single sealed envelope addressed & send to office of the undersigned through registered  Courier/Postal Service. The bids received by hand, not Registered Courier Service and late shall not be entertained.

3. Technical proposal/Bids will be opened in the office of the Chairman Procurement Committee, PDA along with members of the Procurement Committee in the presence of contractor or their representatives. In case if technical Bids/ Proposal are not opened on the above mentioned date due to unforeseen reason these shall be opened on the next working date at the same place & time.

4. The “Technical Proposal/Bids” of the firm/ contractors will be evaluated in accordance with laid down evaluation criteria based on the following documents to provide in the Bidding documents meant for submission of Technical proposal.

1. Details of projects of similar nature related to the above mentioned work undertaken by the firm in the last 5- years (in hand/completed) supported by documentary evidence such as work orders/completion reports in original or attested copies.
2. Financial status. Bank Balance & Certificate from the schedule bank for the last 3 years.
3. The income Tax Certificate / NTN from the concerned Department showing Tax payments regarding works/projects executed during last 3-years.
4. Detail of Technical Staff for the proposed project, duly supported by attested credentials.
5. If any document submitted along with bid documents found false /bogus the registration of the contractor/ firm shall stands cancelled/black listed.
6. An affidavit that there is no dispute of the firm with any department involved litigation / arbitration on the left over/ incomplete projects.
7. The firm / Contractor having their own Tools and machinery required for the above works and Registered Electrical & Mechanical Work Shop.

8. All the bidders are required to be registered with the Khyber Pakhtunkhwa Revenue Authority (KPRA) under Khyber Pakhtunkhwa Finance Act No. XXI of 2013.

5. The “Financial bids/Proposal” of only technically responsive qualified bidders will be opened after evaluation of technical Bids in the presence of bidders/their representative (Who may like to attend) in the office of the office of the undersigned by the Tender opening Committee of PDA on the date and time to be notified later on whereas the “Financial Bids” of technically non responsive bidders shall be returned unopened to the respective contractors.

6. 2% (two percent) earnest money/bid security of the Engineer Cost Estimate must be accompanied with the Financial Bed in the shape of Call Deposit in name of the Director General, Peshawar Development Authority Peshawar, from scheduled banks in accordance with the Rule 20(2) of KPPRA Rules 2014 and subsequent amendments (if any).  Copies of the requisite documents like enlistment/renewal, Income Tax Certificate and PEC Registrations, Active NTN, Affidavit of never been black-listed by the Government / Semi-Government or any Autonomous body, etc must be attached with the Technical bidding documents, while original be produced to the Tender Opening Committee for confirmation at the time of opening of the tender.
7. The Contractors / Bidders who quote their Bids/ Rates upto a limit of 10% Below the Engineer’s Estimate shall submit Bid Security @ 2% of Engineer Estimate only as per KPPRA vide Notification No. S.R.O (14)/Vol: 1-24/2021-22 dated May 10, 2022/6058-71.

1. The Contractors quoting their bids more than 10% below upto 20% below on Engineer Estimate shall submit along with their bids 8% additional security of Engineer Estimated bid cost in addition to 2% bid security. If the bid is not accompanied with the required amount additional security than it will be considered as non-responsive and the 2% bid security shall forfeited in favour of Government and the 2^nd lowest bidder and so on will be considered accordingly.

2. Similarly a contractor quoting bid more than 20% below shall submit with his bid an additional security on Engineer Estimated Cost equal to differential amount of submitted bid and Engineer Estimate along with detailed rate analysis. In case of more than 20% below bids, if the bid is not accompanied by the detailed rate analysis and / or required amount of additional security, then the said bid shall be considered as non-responsive all the securities submitted along with such non-responsive bid shall be forfeited in favour Government and the 2^nd lowest bidder and so on will be considered accordingly.

3. The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertisement procurement opportunity afresh.

8. Incomplete /disfiguring/overwriting/ delayed bids shall be considered non responsive. 

9. All federal and provincial duties/stamp duty/taxes including kpra sales tax etc will be recoverable as per directives of the government issued from time to time.

10. In case the bid becomes tie, it will be decided through open draw.

11. The procuring entity may reject any or all bids at any time prior to the acceptance of a bid. The procuring entity shall upon request communicate to any contractor who submitted a bid, the grounds for rejection of all bids, as per KPPRA Rule 47(1).

12.  Validity of bid will be 90 days from the date of opening of bids. Bid security of the bidder shall be retained by the procurement entity till approval of tender or bid validity period.

13. All the bidders must be registered and in the active Tax payer list of the Khyber Pakhtunkhwa Revenue Authority, established under the Khyber Pakhtunkhwa Finance Act,2013(KP Act No  XXI of 2013.
14. Any corrigendum / addendum in aforementioned terms and conditions would be communicated to all the issuers.

15. Other terms and conditions can be seen in the office of the undersigned on any working day during office hours.
